Chromalox Minimum Advertised Price Policy

Effective August 1, 2018

Chromalox has established a Minimum Advertised Price (MAP) policy for all Chromalox products, both standard and custom. This policy is being implemented unilaterally, and Chromalox will not ask for or accept any assurance of compliance or agreement.

No Chromalox Distributor or Reseller may advertise any price for a Chromalox product that is lower than the MAP for that product. In all cases, the MAP is the Chromalox List price. This MAP policy applies to all Chromalox Distributors and Resellers within the United States, pertains only to advertised prices and does not relate to the actual sale price. Distributors and Resellers are free to set their own prices in actual transactions.

This MAP policy enhances Chromalox’s ability to compete with other brands and ensures that all Chromalox products are properly positioned in all forms of advertising, including, without limitation, print, online and internet communication (e.g. e-mail, web sites), catalogs, direct mail advertising and other media.

Advertising Chromalox products below MAP would result in the following actions by Chromalox:

  • First offense: 30-day suspension of the customer’s status as a Distributor or Reseller.
  • Second offense within 3-years of the first offense: Indefinite suspension of the customer’s status as a Distributor or Reseller.
  • During the suspension period, Chromalox will not offer pricing or take new orders from any suspended Distributor or Reseller. Any order received prior to the suspension will be processed.

Chromalox reserves the right to make changes to the MAP policy at any time. Chromalox reserves the right to make its own unilateral determination as to whether a practice or action is consistent with our MAP policy.
